What immigration statuses are eligible for Medicaid?
Qualified non-citizens are lawfully present and include:
- Lawful Permanent Resident who entered the United States after August 22, 1996
- Asylees
- Refugees
- Cuban/Haitian entrants
- Paroled into the United States for at least one year
- Conditional entry granted before 1980
- Battered noncitizens, spouses, parents, or children
- Trafficking victim and spouse, child, sibling, or parent or have a pending application for a victim of trafficking
- Granted withholding of deportation
- Member of a federally recognized Indian tribe or American Indian born in Canada
- Citizens of the Marshall Islands, Micronesia, and Palau who are living in one of the U.S. states or territories
Lawfully present includes non-citizens who are:
- In a valid nonimmigrant status
- Paroled into the United States for less than 1 year, except for a noncitizen paroled for prosecution, for deferred inspection or pending removal
- proceedings
- Granted temporary resident status
- Granted Temporary Protected Status (TPS)
- Granted employment authorization
- A Family Unity beneficiary
- Covered by Deferred Enforced Departure (DED) per a decision made by the President
- Granted deferred action, except for individuals granted Deferred Action for Childhood Arrivals
