  • Granted withholding of deportation
  • Member of a federally recognized Indian tribe or American Indian born in Canada
  • Citizens of the Marshall Islands, Micronesia, and Palau who are living in one of the U.S. states or territories

Lawfully present includes non-citizens who are:

  • In a valid nonimmigrant status
  • Paroled into the United States for less than 1 year, except for a noncitizen paroled for prosecution, for deferred inspection or pending removal proceedings
  • Granted temporary resident status
  • Granted Temporary Protected Status (TPS)
  • Granted employment authorization
  • A Family Unity beneficiary
  • Covered by Deferred Enforced Departure (DED) per a decision made by the President
  • Granted deferred action, including individuals granted Deferred Action for Childhood Arrivals
